A defendant shall be punished by imprisonment for a term of one year and two months.

The evidence seized shall be confiscated from the accused.

Punishment of the crime

On December 23, 2014, the Defendant was sentenced to a suspended sentence of one year and six months for a violation of the Act on the Control of Narcotics, Etc. at the Daejeon District Court on December 23, 2014, and the said judgment became final and conclusive on December 31, 2014, and was punished four times for the same crime as at the present time.

1. No person, other than a person handling narcotics, etc., who violates the Act on the Control of Narcotics, etc. (flapsying), shall trade, assist in the trade of, give, receive, or administer psychotropic drugs (hereinafter “copon”), and the Defendant is not a person handling narcotics.

On March 2016, 2016, the Defendant called NAV using the word “C” on the Internet portal site, and sent 0.7g of philopon to the nameless person, who ordered 0.7g of philopon to transfer 500,000 won to the nameless person, and then purchased 0.7g of philopon, which was ordered as above, from the world near Seo-gu, Seo-gu, Seoul.

Accordingly, even if the defendant is not a person handling narcotics, he traded a philophone.

B. The Defendant, on March 2016, administered philophones, at the residence of the Defendant, in the Seo-gu, Seo-gu, Seoul, around March 2016.

A total of three times, as described in attached Table 1, the Defendant’s house administered 0.03 gramphones as purchased by diversating 0.03 grams, inserting the phiphones into a single-use divers, and injection them into the Defendant’s arms at that time.

Accordingly, even if the defendant is not a person handling narcotics, he administered philophones.

2. Any person who violates the Act on the Control of Narcotics, etc. (the act of smoking marijuana) shall not smoke marijuana or marijuana seed coats nor carry them for the purpose of smoking, and shall not cultivate, possess, possess, give, receive, keep or use marijuana by any person other than the person handling narcotics;
