The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal (misunderstanding of facts) taken into account the following: (a) the overall purport of the testimony by the defendant was that the defendant took place in office by acting driving on behalf of the defendant; (b) the defendant provided money to the acting engineer; (c) the defendant did not attract or assist the acting engineer in giving money; (d) notified the acting engineer that he did not make efforts to identify the exact address of E; (c) the acting engineer did not make efforts to identify the exact address; (d) the acting engineer did not have any reason to escape before or during driving; and (e) the defendant requested the investigation of the defendant at the time when he was investigated into the crime of drinking alcohol; and (e) there was no fact that the defendant made a false testimony contrary to memory, as stated in the facts charged, but the judgment of the court below which acquitted the defendant of the facts charged of this case and acquitted the defendant of this case
2. Determination
A. The summary of this part of the facts charged is that the Defendant appeared as a witness of the Defendant’s case in violation of the Road Traffic Act (dacting driving) against the above court No. 2015 and 1649 E on November 2, 2015, and was notified of the right to refuse to testify and the punishment for perjury, and thereafter became a witness of the above Defendant case.
