1. 1. 모욕 피고인은 2013. 1. 19. 16:05경부터 18:30경까지 충남 서산시 읍내동에 있는 서산경찰서 유치장에서 배식시간이 아님에도 불구하고 “밥을 달라, 내보내 달라”는 등의 요구를 하였으나 이를 들어주지 않는다는 화가 나서 피고인 외에 다른 유치인 4명이 듣고 있는 가운데 당시 근무 중인 충남서산경찰서 소속 경사인 피해자 I에게 “이 십새끼들아, 이 개같은 새끼야, 이 좆같은 짭새 새끼들은 없어져야 해, 네 애미 십보지에 좆을 박고 뒤져라, 이 씨팔놈들아, 귓구녕 쳐 박혔냐, 경찰 나부랭이 새끼들아, 선량한 사람 가둬두지 말고 이 씹새끼들아 당장 풀어줘라, 이 간나 개새끼들아, 안 그럼 나가 뒤져라”라고 욕설을 하여 공연히 피해자를 모욕하였다.
