1. Of the judgment of the court of first instance, the part against the plaintiffs, which ordered payment, shall be revoked.
Reasons
1. Basic facts
A. The status of Plaintiff A as a party is that Plaintiff A entered into an employment contract with the principal of each school (referring to two public schools; hereinafter “each school of this case”) from March 1, 1993, Plaintiff B, from March 1992, and Plaintiff C, from April 18, 1995, to FJ from April 18, 1995, and employees in charge of the affairs of printing and administrative office support (hereinafter “existing employees”) under the orders of the principal of the school and receive wages from the school accounting established in each school pursuant to Article 30-2(1) of the Elementary and Secondary Education Act.
(For this reason, although they are in the same position as the plaintiffs and those subject to the annual salary system as shown below, they are collectively referred to as "school accounting staff". The defendant is a local government which establishes and manages each of the schools in this case and administers its affairs pursuant to Article 2 of the Local Education Autonomy Act.
B. Article 8(1) of the former Rules of Employment (hereinafter “Rules of Employment”) established by the Office of Education under the jurisdiction of the Defendant (hereinafter “Rules of Employment”) around 1997 provides that “The remuneration for employees of the parents’ association of various levels of schools shall be paid based on the 10th class public officials in technical service and the 10th class salary for the 10th class public officials in technical service under the Public Officials Remuneration Regulations [Attachment 8; hereinafter the same shall be omitted].” The Defendant middle school under the jurisdiction of the Defendant established and implemented the Personnel Management Regulations under the above. (2) The Office of Education established and implemented the Personnel Management Regulations under the jurisdiction of the Defendant each year “Basic Guidelines of the School Accounting Budget” and the 2003 Guidelines in 204 shall be paid within the scope of the 10th class public officials in technical service or the 3th class public officials in employment depending on their duties.
