Reasons
1. Facts of recognition;
A. 1) The Plaintiff is an incorporated foundation established with the purpose of owning, managing, and supplying necessary assets for the development of the G principal church, its affiliated branch church, and its affiliated organizations. 2) On November 10, 1947, the “I church” located in the Chungcheongnam-nam budget H (hereinafter “previous church”) was established and operated as a branch church affiliated with the G principal church. The “I church” is a church organized by the members, including Defendant B, who had the previous church members, leave the religious order on April 1, 2015, and then the members, including the above members, who agreed to leave the religious order.
B. On July 7, 2012, Defendant B left the previous church as a member of the church, and changed the name of the previous church from the "J church" to the "I church" in around 2013. On October 1, 2013, Defendant B removed the previous church building and promoted the new construction of the church in the same place. In the process, there was a dispute between Defendant B and the members requesting the funding and use of the church construction costs. 2) The previous church held an employee meeting on January 7, 2015, and passed a resolution on only 12 days, who attended the agenda of the previous church’s removal from the previous church to the 12-day honorary church.
3) On April 1, 2015, the previous church held a temporary office general meeting and resolved on the matter of religious order withdrawal, transfer of ownership, and revision of the articles of incorporation with the consent of 24 members present in accordance with the method of a bearer voting (hereinafter “resolution to leave the religious order of this case”).
(4) On May 8, 2015, the G church P Trial Committee decided on May 8, 2015 that the representative of the previous church shall be suspended from office for two years on the grounds of the initial legal church administration and financial management with respect to Defendant B, and on July 8, 2015, Defendant B and the previous church.
