1. The defendant shall be the plaintiff.
A. The registration of the Seoul Eastern District Court and the registration of the Seoul Eastern District Court on each real estate listed in the attached list No. 1.
Reasons
1. Basic facts
A. The plaintiff is a company that is engaged in the real estate leasing and selling business for Btel located in Gwangjin-gu Seoul Special Metropolitan City, and the defendant is a non-corporate company comprised of the plaintiff's creditors.
B. On March 8, 2012, the Plaintiff: (a) held a temporary general meeting of shareholders of the instant case (hereinafter referred to as “instant temporary general meeting of shareholders”); (b) held a resolution to appoint H as the representative director of the Plaintiff’s company with the consent of 58% in the presence of D (1,850 shares), E (1,050 shares), F (1,050 shares) and G (1,050 shares) recorded as the Plaintiff’s shareholder at the time of the shareholder registry (Evidence A; (c) held a temporary general meeting of shareholders of the instant case; (d) held a resolution to appoint H as the representative director of the Plaintiff on the same day.
C. The Plaintiff: (a) filed a registration with the Seoul East Eastern District Court on May 13, 2013 with respect to each of the real estate listed in the separate sheet No. 1; (b) filed a registration with respect to each of the real estate listed in the separate sheet No. 1 with the Seoul East East Eastern District Court on May 10, 2013; and (c) filed a registration with respect to each of the real estate listed in the separate sheet No. 2 with respect to each of the above real estate as indicated in the separate sheet No. 4079, Jun. 11, 2013; and (d) filed a registration with respect to each of the real estate listed in the separate sheet No. 32618, May 13, 2013; (b) filed a registration of the right to claim ownership transfer on May 10, 2013 with respect to each of the above registrations with respect to each of the real estate listed in the separate sheet No. 4 with the trust deed No. 3105, Jun. 10, 201013
Since then, H was dismissed from the office of representative director on June 12, 2013, and I was appointed as the representative director of the plaintiff on the same day.
E. (1) On the other hand, as of April 25, 2009, Plaintiff 5,000 ordinary shares were issued, and the share certificates are not issued.
