Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

No person shall allow another person to deliver words, sounds, letters, pictures, images, or other things that may cause a sense of sexual shame or aversion by telephone, mail, computer, or other means of communication, with intent to arouse or satisfy his/her own or another person's sexual desire.

1. 2018. 1. 10. 00:38경 범행 피고인은 2018. 1. 10. 00:38경 서울 이하 불상지에서 소지하고 있는 휴대전화를 이용하여 사실혼 관계에 있는 B의 여동생인 피해자 C(여, 56세)에게 ‘고백할말 있어요 D하고 00씨하고 현장 안에서 올갱이 잡을 때 차타고 현장 지나칠 때 처제가 형부 무슨 생각했어 물을 때 한적한데 가서 처제한테 보지 좀 빨게 해달라고 하고 싶었어요 엊그제 처제가 내 손 만져주는데 좆 빨리고 싶고 처제한테 좆 박고 싶어서 미치는 줄 알았어요 매일 처제 이뻐해주고 싶고 매일 처제 생각하면서 자위한답니다. 어느 순간 착각인지 처제도 나를 좋아하는 느낌받고 죽을 심정으로 글을 씁니다. 한 번만이라도 처제 가랑이에서 폭포수가 나오도록 빨다가 처제 보지에 멍들도록 박아보는 것이 꿈이랍니다 (후략)’이라는 내용의 메시지를 전송하였다.

Accordingly, the Defendant sent to the victim a writing that may cause sexual humiliation and aversion with a view to meeting his own sexual desire.

2. On January 10, 2018, around 00:50, the Defendant sent text messages to the website address where obscene videos are jointly owned by the Defendant using a mobile phone located in a place not exceeding Seoul, around 00:50 on January 10, 2018.

Accordingly, the Defendant reached the victim with language and images that may cause sexual humiliation and aversion with a view to meeting his own sexual desire.
