A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant is the U.S. Armed Forces subject to the usfk Status Agreement (SOFA).
On August 20, 2016, the Defendant was driving a DD on his job and proceeded with the front side road of Yongsan-gu Seoul Metropolitan Government E, from the bank room to the department of the Lee Won-won Fire Station.
Since the place is one-way road with a sign prohibiting entry into the surface, and the passage of pedestrians is frequent, the driver has a duty of care to prevent accidents by driving the road on which entry is prohibited according to the safety marking content.
Nevertheless, the defendant neglected this and proceeded with a road that is prohibited from entering, while crossing the right side of the victim F (32 tax) who crossed the right side of the road in the direction of the direction, and received the front part of the road that the defendant drives.
Ultimately, even though the Defendant suffered from a bridged part of a bridge that requires the victim’s treatment for about two weeks due to the above occupational negligence, the Defendant immediately stopped and escaped without taking necessary measures, such as providing relief to the victimized person.
2. The Defendant, around August 19, 2016, found the U.S. government issuance certificate, which was owned by the victim I lost on the street near H hotel located in Yongsan-gu Seoul Metropolitan Government, around August 23:00.
The defendant did not follow necessary procedures such as returning the above identification card to the victim and did so.
Accordingly, the defendant embezzled the identification card that has escaped from the possession of the victim.
3. The Defendant’s illegal uttering of private documents came to the roads in front of Yongsan-gu Seoul, Yongsan-gu, Seoul, where he was driving in the Otoba as described in paragraph (1) around August 20, 2016.
