Reasons
1. Details of the disposition;
A. An industry-academic cooperation foundation of the Plaintiff A University (hereinafter “Plaintiff-academic cooperation foundation”) is a corporation with the objective of controlling the affairs of industry-academic cooperation of the Plaintiff University.
Plaintiff
A Co., Ltd. (hereinafter “Plaintiff Co., Ltd.”) is a company engaging in software manufacturing and selling business, and Plaintiff C is the representative director of Plaintiff Co., Ltd.
The defendant is a corporation established to efficiently support the planning, management, evaluation, etc. of projects for innovation of industrial technology.
B. On March 4, 2010, the Plaintiff Industry-Academic Cooperation Foundation submitted a business plan (hereinafter “instant project plan”) containing the main institution for the Plaintiff, the general manager D, and participating institutions, as the Plaintiff Company, etc. (hereinafter “E”) to the Minister of Knowledge Economy (amended by Act No. 11690, Mar. 23, 2013; hereinafter “the Government Organization Act”) to the Minister of Trade, Industry and Energy (hereinafter “the Minister of Trade, Industry and Energy”). The main contents are as indicated in the “project plan of the instant task.”
C. On April 5, 2010, the Defendant held an evaluation committee and selected the instant task requested by the Plaintiff Industry-Academic Cooperation Foundation as eligible for support, and the Minister of Trade, Industry and Energy entered into an agreement on the development of the instant task in accordance with the Plaintiff Industry-Academic Cooperation Foundation’s project plan.

Plaintiff
