The defendant shall be innocent.

1. Summary of the facts charged

A. On March 17, 2013, the Defendant: (a) was a foreigner of Chinese nationality who entered the Republic of Korea; and (b) was asked to use a passbook and cash card from victims as a crime of telephone financial fraud, which had been obtained from victims, as the Defendant called to the telephone financial fraud group and victims for lending.

Accordingly, on March 20, 2013, the person who was dissatisfyed by phone call to the victim C, and by deceiving the victim to receive the loan if he opened and sent a new passbook, which is not currently used." In this context, the victim had the victim opened the Agricultural Bank Account in the name of the victim (Account Number: D) and sent the passbook and cash card to the Kwikset service engineer.

In addition, from the end of February 2013 to March 22, 2013, the bearers, by deceiving the victims by the above methods, and by which the victims were forced to send 17 passbooks, 22 bank cards, and 4 copies of passbooks to Kwikset service engineers over a total of 22 occasions, as shown in the attached Form List of Crimes.

After that, around 18:00 on March 23, 2013, the Defendant received the above passbook, card, etc. from Kwikset Service Articles around 12, Yeongdeungpo-gu, Seoul, Yeongdeungpo-gu.

Accordingly, the defendant, in collusion with the above-mentioned telephone financial fraud group, by deceiving the victims, received the above passbook and card from the victims.

B. The Defendant, in violation of the Electronic Financial Transactions Act, received 17 passbooks, 22 bank cards, and 4 copies of passbooks and took over the means of access for electronic financial transactions at the same time, place, and in the same manner as stated in the preceding paragraph.

2. Determination

A. The Defendant’s assertion on fraud part 1 of the crime committed was sent by Kwikset Service Officer with the instant passbook and the card, but Kwikset service from a model resident in China.
