Reasons
Basic Facts
The Plaintiff is the owner of the Gangseo-gu Busan Metropolitan Government D-283 square meters (hereinafter referred to as “the Plaintiff’s land”) and the wooden tank and roof single-story housing (hereinafter referred to as “the instant housing”) and 52.34 square meters (hereinafter referred to as “the instant housing”), and 19.6 square meters (hereinafter referred to as “the instant warehouse building”) of the plastic roof roof single-story warehouse facilities (hereinafter referred to as “the instant warehouse building”).
The Defendant is the owner of Gangseo-gu Busan Metropolitan City road B 15,702 square meters (hereinafter below referred to as “Defendant 1”) and C road C 20 square meters (hereinafter below referred to as “Defendant 2”) adjacent to the Plaintiff’s land.
1) The Plaintiff’s land was registered to preserve ownership in the name of E on November 6, 1941. On October 15, 1972, the Plaintiff’s land was registered to transfer ownership based on the completion of repayment under the Farmland Reform Act under the F on December 31, 1951 under the name of F on October 15, 1972, and the ownership transfer registration based on sale was registered under the name of G on October 1, 1973, and on June 18, 2015, the Plaintiff’s land was registered to transfer ownership based on sale under the Plaintiff’s name.

In addition to the Plaintiff’s land, the warehouse building of this case is located on the ground of 10 square meters (hereinafter “the part occupied in the warehouse of this case”) in part (i) of 10 square meters in order to connect each point of the attached drawing No. 5, 6, 7, 8, 4, and 5 of the Defendant’s land in this case, other than the Plaintiff’s land.
3) On the ground of the Plaintiff’s land of this case, the mentmen’s black gar and apap assessment 10 square meters per unit and 10 square meters per unit and 4 square meters per unit of garment block, each of which was constructed around 1960 on the ground of the Plaintiff’s land of this case.
