2. 피고인 H 피고인은 제 1 항 기재 일시, 장소에서, 위와 같이 A, G이 피해자를 주차장 안으로 끌고 가 폭행하는 도중에, O이 이를 저지하려 하자, A, G과 함께 O에게 욕설을 하며 그의 몸을 붙잡아 가로막는 한편, 주차장 안으로 들어가 발로 피해자의 얼굴, 몸통과 다리를 걷어찼다.
