Reasons
Punishment of the crime
On December 31, 2013, the Defendant, as a C-si driver, was carrying the victim D (the victim, who was a guest) in the si on the 200:35 on December 31, 2013, and was in dispute with the Defendant.
After stopping in the Dong-gu E-F volume, the Defendant: (a) stopped in the Dong-gu E-F volume; (b) brought the victim “I would not get a taxi fee; (c) brought the victim to close the door while getting down, and (d) brought about approximately 14 days on the part of the victim, who gets off from the driver’s seat and walked twice the part of the victim’s ship, thereby getting off about 14 days to undergo a medical treatment.

1. The defendant and defense counsel asserted that the defendant and defense counsel did not consent to the victim.
The evidence duly adopted and examined by this Court reveals the following circumstances.
① After preparing a written statement at an investigative agency immediately after the crime of this case, the victim stated that there was an assault against the victim’s body part, other than the clothes, at least four to five times, and that there was an assault against the victim’s body part other than the clothes. However, when making a statement at an investigative agency, the victim explained that there was no mind that there was two times in the statement, and that there was two times in the statement, and that there was two times in the same manner as the victim stated at an investigative agency, it does not appear that the victim’s statement was reversed to the extent that the victim’s statement was not acceptable, in light of the circumstances that the victim had been aware of his play and drinking even after the crime of this case was committed.
② The victim was a cab to return home to the company employees and the company staff, and immediately after the crime of this case was committed, the victim called the male-gu and the company staff.
