1. The portion of the instant lawsuit claiming rent shall be dismissed.

1. Facts of recognition;

A. From January 7, 2011 to April 9, 201, the Defendant operated a restaurant with the trade name “B” in each of the instant real estate. On April 11, 2012, the Defendant: (a) from the Plaintiff, the deposit amount of each of the instant real estate owned by the Plaintiff is to pay KRW 40,000,000, monthly rent of KRW 4,000, monthly rent of KRW 400,000, monthly rent of each of the said real estate; and (b) the lease period was respectively leased from May 10, 2012 to April 9, 2014; and (c) relevant matters between the Plaintiff and the Defendant at the time are as follows:

Value-added tax is separate.

When the contract expires, the defendant shall not claim the amount to the plaintiff under any pretext, such as the right fee, the installation cost of facilities, the interior cost, etc.

B. Meanwhile, on June 18, 1998, Gwangju Bank completed the registration of creation of each of the instant real estates with the maximum debt amount of KRW 1,800,000,000, and gold Integrated Finance Co., Ltd. with the maximum debt amount of KRW 1,300,000 on May 4, 2007.

On July 5, 2011, Dongjak-gu Seoul Metropolitan Government completed the entry registration of each seizure on the real estate listed in the separate sheet No. 2-6 in the separate sheet No. 2-6 on August 16, 201, and on each real estate of this case, the registration of each seizure on each of the real estate listed in the separate sheet No. 1 in the separate sheet No. 1 on August 16, 201 was completed. With respect to each of the real estate of this case, the Korea Deposit Insurance Corporation of the Bankrupt Savings Bank Co., Ltd., Ltd., made a provisional attachment order of KRW 1,60,000,000 on September 3, 2013, and the Korea Deposit Insurance Corporation of the Republic of Korea (Seoul Metropolitan Government Office of Disposition) on seizure on September 23, 2013, while Gwangju Bank of Korea completed the entry registration of the decision of voluntary commencement of auction on December 27,

On the other hand, with respect to real estate listed in paragraph (1) of the attached list, the Songpa-gu Seoul Metropolitan Government completed the provisional attachment registration on February 3, 2014 by the trustee in bankruptcy of the bankrupt debtor promotion savings bank corporation on August 13, 2015 on the claim amount of 1,00,000,000.

C. The Republic of Korea, on November 4, 2013, collected the amount of national taxes in arrears of KRW 183,003,630 against the Plaintiff on November 4, 2013, pursuant to Article 41(1) of the National Tax Collection Act.
