Defendants shall be acquitted respectively.

1. The summary of the facts charged is that the Defendant: (a) around January 26, 201, at his own house located in Chungcheongnam-gun, Chungcheongnam-gun around July 2001, L grants KRW 4 million to M at the seat of F, A, G, H, I, J, F, andK located in D around July 2006; (b) at the seat of D around July 2006, L withdraws to F, G, H, J, F, and K; (c) at the time of Seoul, 2.1 million won; and (d) at the face of 1.9 million won, M withdraws voluntarily withdrawn from F, and at the same location, the Defendant stated F’s confirmation column stating that “K is written directly by F,” with the sign of “K,” and written confirmation on the rights and obligations of K, with the intention of exercising its signature on the name “K.”

On January 26, 2011, after forging Chapter 1, the public service center of the original public prosecutor's office located in 31-No. 31-No. 1-ri, Chang Chang-gun, Chang-gun, Chungcheongnam-gun, Seoul, issued the instant letter of confirmation, which is a forged private document, to an employee in charge of civil service affairs who is unable to know his/her name of forgery, and exercised it as if it was duly completed.

2. The summary of the defendant and his defense counsel's assertion is that the defendant prepared the letter of this case after obtaining the consent of K, so there is no intention to forge private documents and to commit the same uttering.

3. Determination

A. The prosecutor instituted the instant indictment on the ground that “the Defendant prepared the instant confirmation document without the permission of K,” while the Defendant, at around January, 201, sent the instant confirmation document to E in order to obtain the seal of K, and after reading the confirmation document by K, he stated that “When leaving the stamp, he/she will affix his/her seal after leaving the stamp.” After going to E, he/she did not affix his/her seal, while sending the confirmation document to K, and without affixing his/her seal, he/she calls to K.”
