Reasons
Punishment of the crime
The Defendant is the president of the “D Child Care Center” in Chungcheong-gun C.
In fact, the Defendant did not meet the requirements for receiving care allowances for improvement of treatment, which is a subsidy for childcare teachers who worked for 8 hours prior to a day, since the above childcare teacher E was employed only on a A.M., due to the above E’s am working hours, the number of hours per day exceeds 1:5,00 children’s ratio of designated teachers, and thus, he did not meet the requirements for receiving the basic childcare fees that are paid as the requirement for compliance, but he did not work on the preceding day, and received a false subsidy by applying for a false subsidy as if he satisfies the above requirements.
On March 2010, the Defendant access to the childcare integrated system that manages subsidies, etc. for childcare centers by computer, and the facts are as follows: (a) input false information on infant care teachers as if E was working on the day eight hours a day before the day while E was working; (b) received allowances, such as improving the treatment of infant care teachers totaling KRW 5,480,00 as stated in attached Table 1 from the Cheongyang-gun Office that believed such information as a fact, and received the basic infant care fees of KRW 19,349,868 in total, as stated in attached Table 2, from February 2012.
As a result, the Defendant received a total of KRW 24,829,868 from the Cheongyang-gun Office by fraud or other improper means.
