Reasons
Punishment of the crime
【2016 Highest 1998】
1. Defendant A
A. On December 16, 2015, the Defendant posted a letter to the effect that “EPC” located in Ulsan-gun, Ulsan-gun, U.S., U.S. A, by accessing the Internet “number-place” website by using smartphones, and “blucing-line crowdfunding is sold.” The Defendant reported it to the effect that “the Defendant will send the money to the victim F, who sent the money.”
However, the defendant did not have the idea that he will receive money from the victim to use it as living expenses for the defendant, etc., because he did not have the spread, there was no intention or ability to send the spread even if he receives the price for the goods from the victim.
The Defendant, by deceiving the victim as above, received KRW 300,000 from the victim to the Agricultural Cooperatives Deposit Account (H) in the name of G on the same day, and received KRW 300,000 from around that time to January 30, 2016, total amount of KRW 2325,000,000, as shown in attached Table 1, from around that time.
B. Around 13:00 on March 25, 2016, the Defendant sought a school in which the victim I (Nam, 16 years of age) was enrolled, and the Defendant moved the victim to a public toilet installed in the K market located in the Ulsan-gunJ in Ulsan-gun, Ulsan-gun.
The Defendant saw the victim's "if you were to see why it would have been satisfed or would not have been satisfed if you were satched or would have been sat." The Defendant satched the victim over 10 minutes.
The Defendant, as such, received 70,000 won from the victim who threatened the victim and received 70,000 won over two occasions, and from around that time, received a total of 23 times during the period from February 2, 2016, 50,000 won from the victim, as shown in attached Table II.
2. On November 30, 2015, Defendant B, at “EPC” located in Ulsan-gun, Ulsan-gun, U.S., U.S., Defendant, using smartphones, connected to the Internet “number opening site” website and carried out “Bck-cocking.”
