A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 6, 2012, the Defendant registered a petroleum retail business (registration number B) with the captain-Gun office on December 6, 2012 and runs a petroleum retail business with the trade name of "D gas station" in Busan-Gun C.

No one shall manufacture, import, store, transport, keep, or sell fake petroleum products.

Nevertheless, the Defendant, in collusion with E who is an employee of the above station, manufactured fake petroleum and sold it for the purpose of disposing of light oil and oil before the suspension of business, where the above gas station was discovered at the time of the joint inspection by the Yong-Nam headquarters and the plane captain office, and a penalty surcharge of KRW 100 million is not paid from the plane captain's office until May 3, 2013.

1. The Defendant, in collusion with E on April 6, 2013, from around 13:00 to around 15:00, within the aforementioned “D gas station”, the Defendant: (a) deducted 600 litres from transit 600 litress stored in a transit storage tank No. 1 fuel oil tank; (b) moved 1,400 litres from transit 1,400 litres, which are stored in a 3rd oil storage tank using a emulative organic substance; and (c) moved 1,400 litres from transit 3:0 litres from the above mobile oil tank; and (d) manufactured 2,00 litres from petroleum stored in an existing 80 litres storage tank; and (d) sold 2,80 litres from 2,800 litres from petroleum on a total of 2,80 litres from 4,300 litress from the vehicle; and (d) sold 301,4000 201.60 lit.20

2. On April 24, 2013, from around 13:50 to 14:16, the Defendant in collusion with E, deducted transit 300 liters, which were stored in the transit storage tank No. 1 in collusion with E, from 3:50 to 14:16, and then moved 30 liter to a F mobile oil vehicle.
