Punishment of the crime
[2016 Highest 1160] Around 03:31 November 24, 2015, the Defendant drinks in a 'E' restaurant working for the victim D (26 years of age) located in Dongdaemun-gu Seoul, Seoul. On the ground that the above restaurant customer’s operation “F” shop in front of the above restaurant would interfere with the above main shop business by smoking tobacco, and thus, it would interfere with the above main shop business, while the above restaurant customer had a good appraisal of the victim, the Defendant said that “I want to smoke in front of our shop, I would like to do so with the president, I would like to do so.” However, the Defendant saw the victim’s words “I would have no president, I would like to do so, I would like to do so.” However, the Defendant saw the victim “I would like to do so, I would like to do so, without fluen, ch flue, franch, and franch.”

1. At around 22:00 on the same day, the Defendant, via the open entrance of the above apartment, went to the front corridor of the victim’s residence and intruded the victim’s name, opened the entrance door, and obstructed the disturbance into the residence used for public use by the aforementioned apartment residents including the victim.
