Reasons
Punishment of the crime
[2013 Highest 2283] The Defendant, around April 2, 2013, sold a member C apartment 704 Dong-gu 46, Ansan-si, Ansan-si, and paid the price to the victim by the 9th day of the same month after selling the D Sp-type car owned by the victim B, and received the said vehicle from the victim.
On April 2, 2013, the Defendant sold 50,000 won in cash from G to “F trading company” G, and received 8,950,000 won in cash from G to the Defendant’s bank account (H) and kept in custody for the victim on the same day, the Defendant arbitrarily consumed KRW 8,50,000 in total as indicated in the attached list of crimes.
Accordingly, the defendant embezzled the victim's property.

1. Around February 27, 2013, the criminal defendant against the victim (the victim)J made a false statement that "M will make a loan to the victim for the purchase of a PP car at the 3rd floor of the K Hospital in Ansan-si, the 3rd floor of the KJ office in Ansan-si, and that "M will make a loan to the victim (the victim)" to the L who is an employee in charge of the loan of the (victim)J. On April 18, 2013, the Defendant’s fraud against the Victim N is that, while displaying the victim N’s used cars pictures listed on the Internet at the P Office located in Ansan-si, an Ansan-si, the Defendant would sell and purchase multilateral vehicles listed on this Internet site with payment of KRW 4.9 million.
