A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

C From January 2009 to July 201, 2010, the construction work of F Co., Ltd. (hereinafter referred to as “F”), the contractor of “D apartment” in the Cheongju City, as the head of the construction project headquarters of F Co., Ltd. (hereinafter referred to as “F”), was in charge of domestic apartment construction work and apartment sale.

G as a regular business of F from around 2005 to July 2010, the housing project headquarters (the change of the name to the building project headquarters around 2008) overall control over the affairs of housing project teams and housing marketing teams (the change to the name to the unit planning team) and was in charge of establishing apartment sale, unsold housing sale, and unsold apartment sales and occupancy strategies.

H worked as the deputy head of F's Housing Marketing Team and the head of housing marketing team from March 2009 as the head of the housing marketing team team from January 2007, in charge of establishing apartment sale, unsold housing sale, and unsold apartment sales and occupancy strategies.

I worked at F's Housing Marketing Team from January 2007, and served as the head of the above D Apartment Sales Office from January 2008.

J is the head of the group of the apartment sale agent company K (hereinafter referred to as the "K").

Defendant, L, M, and N are people soliciting the name holders necessary to receive apartment intermediate payments by pretending that they purchased the above D apartment.

The executives and employees of F, such as C, G, H, and I, constructed the above D apartment and sold it in lots from April 2008, but at least 50 square meters of sale, lack of construction funds and other corporate operation funds. As part of the "plan to improve the sale rate for securing liquidity" around March 2009, F executives and employees and their family members and other employees of F F collaborative companies and affiliates, such as companies supplying ready-mixeds at the construction site of the above D apartment, and their family members or other persons, and they borrowed their names from the general public recruited through K, the above D apartment sales agent, and they purchased the above D apartment.
