A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 11, 2015, the Defendant, who violated the restriction on contribution and door-to-door visits, went out as a candidate for the head of the agricultural cooperative association in pet-gun, C.C., and resigned from the candidate around March 8, 2015, which was implemented on March 11, 2015.

A candidate shall not provide money, goods, or other property benefits, or express his/her intention to provide such benefits, in connection with the relevant commissioned election from 180 days ( September 21, 2014) to the elector, his/her family members, etc. from 180 days before the expiration date of the period subject to restriction on contribution acts until the election day ( March 11, 2015), and no one shall visit the elector door to door, or gather it in a specific place for an election campaign.

Nevertheless, on March 3, 2015, from around 06:00 to 07:30 on the same day, the Defendant introduced the Defendant as a candidate for election of the president of the association to E in front of the house of E, a member of the said association, which is located in Jeon-gun, and offered 50,000 won between the two pages of the Defendant’s campaign name letter to put 50,000 won in cash, and provided 10,000 won in cash to 7 members of the said association, who reside in the said F Village, who are members of G, H, I, J, J,K, and L house, respectively, in the same manner.

At around 11:00 on March 4, 2015, the Defendant continued to provide KRW 100,000 in cash to the head of Qu, located in the P Village of the Haju-gun of the North Korea, who is a member of the said cooperative, “I am well known to be a candidate for the head of the cooperative.” After the Defendant’s order, the Defendant received 50,000 won as a candidate for the head of the cooperative, and provided KRW 100,000 in cash from the head of Q, located in the P Village of the North Korean Dos of the Republic of Korea on the same day at around 22:0 on the same day.

As a candidate, the defendant provided a 90,000 won in cash to the elector or nine family members during the contribution-restricted period, and provided a house-to-house visit (7 members such as F Village E and 8 members of Guldong Village).

2. Candidates who violate the method of distributing election campaign bulletins and name cards; and
