1. 피고인은 2013. 10. 17. 13:31경 천안시 B에 있는 'C' 모델하우스 식당에서, 동영상 촬영기능을 켠 상태로 피고인 휴대폰을 검은색 치마를 입은 여성인 피해자 성명불상자의 치마 밑에 집어넣는 방법으로 피해자의 치마 안을 피해자의 의사에 반하여 촬영하였다.
