A defendant shall be punished by imprisonment for seven years.

Punishment of the crime

[criminal power] On June 16, 2011, the Defendant was sentenced to imprisonment with labor for a violation of the Customs Act, etc. by the Daegu District Court, and on October 28, 2011, the period of parole was expired on December 21, 201 when the sentence was executed by the Daegu Detention Center.

【Criminal Facts】

The Defendant, who is not a handler of narcotics, is aware of in C and Daegu while engaging in the clothing business, and D is the friendship of C.

The Defendant, while engaging in trade business in Madong-si in China, was unable to operate a business due to lack of funds, brought in and sold phiphones distributed in China into the Republic of Korea to raise funds. On August 20, 2014, at a restaurant where the name located in the Firre in Daegu E cannot be known on August 20, 2014, the Defendant: (a) concealed the phiphones from China to Korea; (b) delivered them to C via an international cargo line, and (c) intended to divide the profits therefrom. (d) On August 20, 2014, the Defendant: (e) concealed the name of the Firre in Daegu E from August 23:15, 2014, and conspired to sell the phiphones to D; (e) sold the phiphones to Korea; and (e) promised to divide the profits therefrom.

1. On September 2014, the Defendant purchased approximately KRW 347.2g, a psychotropic drug, from a Chinese person (one-name “G”, approximately KRW 50 years of age), the name of which is unknown at an office in which it is impossible to identify the trade name in the Chinese Maddong-si Maddong-si, China, for approximately KRW 15 million.

2. On September 24, 2014, at around 16:30, the Defendant: (a) sealed approximately 347.2g of the philopon in the back of H Hospital located in the Madong-si of Incheon in the Madong-si, as described in the foregoing paragraph 1., into four red plastic bags; and (b) sealed them in the face of four red plastic bags; and (c) allowed the Defendant to pass through an international cargo quarantine inspection station in the Incheon International Passenger Terminal located in Incheon City, Incheon, on September 24, 2014, using international cargo ships departing from the port for danger and injury to Chinese mountain traffic, and D around 13:11, Sept. 25, 2014.
