A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[2] On July 23, 2008, the Defendant was sentenced to a suspended sentence of six months for intrusion upon a structure at night, larceny, etc. at the Incheon District Court; on February 4, 2009, the Defendant was sentenced to a four-month imprisonment with prison labor for intrusion upon residence at night, larceny, etc. at the Seoul District Court; on September 4, 2009, the sentence of the said suspended sentence becomes effective; on September 4, 2009, the execution of the said sentence was terminated at the first school of North Korean Dos around Suwon-do; on January 5, 2010, the Defendant was sentenced to a one year and six months for violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Suwon District Court at the time on May 3, 201; on September 30, 2011, the Defendant was sentenced to imprisonment with prison labor at the Daejeon District Court at the end of one year and six months at the same time on September 21, 2011.

[Criminal facts] The Defendant committed the following crimes under the conditions that the Defendant lacks the ability to discern things or make decisions due to intellectual disability of even though they committed the following crimes.

On August 15, 2017, around 18:45, the Defendant: (a) intruded into the original office managed by the victim E of the D Hospital in Ma, and stolen the victim’s cash of KRW 180,000,000, which was kept in the West of the reception counter; and (b) during the period from around 18:45 to August 22, 2017, the Defendant habitually stolen or attempted the victims’ property for ten occasions in total, such as the list of crimes in the attached list.
