Reasons
1. Criminal facts;
A. The Defendant in violation of the National Health Insurance Act is a doctor who operates a department of family affairs in Daegu Northern-gu C.
On June 14, 2013, the Defendant received the amount of KRW 315,904,00 from March 2, 2016, by claiming KRW 7,830 to the National Health Insurance Corporation for medical care benefits at around that time, from the time when he/she received the above medical care benefits to March 2, 2016, as shown in the attached Table 19-52, from the time when he/she received the above medical care benefits, although he/she was unable to issue a prescription without a direct medical examination.
As a result, the defendant received insurance benefits or let another person receive insurance benefits by fraud or other improper means.
(b) No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number;
On January 7, 2012, the Defendant illegally used E’s resident registration number on the medical record book that he left at the above hospital and did not receive any treatment as a obstruction of opening and maintaining the water surface (influence), and prepared that E received treatment under the above sick name and received prescription, and used E’s resident registration number on 47 occasions in total, such as the [Attachment] No. 6 to 52 [Attachment] list from the above day to March 2, 2016, between the above day and March 2, 2016.
2. Determination
A. As to the violation of the National Health Insurance Act, this part of the criminal facts against the Defendant are as follows: (a) by falsely stating the fact that the Defendant received medical treatment from the National Health Insurance Corporation; and (b) claiming the National Health Insurance Corporation a total of 315,904 won for medical care and travel expenses on a total of 34 occasions, the Defendant received insurance benefits or
National Health Insurance Act, March 22, 2016.
