Defendants shall be punished by a fine of KRW 2,000,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

1. The defendant A shall not obtain a construction machinery pilot's license by fraud or other improper means;

Nevertheless, the defendant, in collusion with G, the head of FF private teaching institute in Jinju-si E, was issued a false certificate of completion of training for small-sized construction machinery operation under the name of the head of FF driving school although he did not complete the education for 6 hours in theory necessary for obtaining a license at F driving school. On January 12, 2016, the defendant was issued a false certificate of completion of training for small-sized construction machinery operation after submitting a false certificate of completion to the public official in charge of private viewing and listening.

Accordingly, the defendant has interfered with the public official's performance of official duties by fraudulent means, and has obtained a construction machine pilot's license by illegal means.

2. No person who intends to obtain a construction machinery pilot's license by fraud or other improper means;

Nevertheless, the defendant, in collusion with G, the head of FF private teaching institute in Jinju-si E, was issued a false certificate of completion of training for small-sized construction machinery operation under the name of the head of FF driving school although he did not complete the education for 6 hours in theory necessary for obtaining a license at F driving school. On January 5, 2016, the defendant was issued a false certificate of completion of training for small-sized construction machinery operation after submitting a false certificate of completion to the public official in charge of private viewing and listening.

Accordingly, the defendant has interfered with the public official's performance of official duties by fraudulent means, and has obtained a construction machine pilot's license by illegal means.

3. The defendant C shall not obtain a construction machinery pilot's license by fraud or other improper means;

Nevertheless, the defendant, in collusion with G, the head of FF private teaching institute in Jinju-si E, was issued a false certificate of completion of the training course for small and medium-sized construction machinery in the name of the head of FF driving school although he did not complete the training course for 6 hours at the F driving school necessary for obtaining a license at the F driving school.
