A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. Larceny;
A. At around 00:30 on June 1, 2013, the Defendant cut off a 600,000 won of the market price consisting of 18K Women E, the victim E, who was placed on his/her own, with 18K Women’s Sheet and Sheet in an amount equivalent to 300,000 won of the market price, one set of 1,000,000 won of the market price, one citizen’s card, one copy of the agricultural physical card, one copy of the agricultural bank card, one resident registration certificate, etc.
B. On June 7, 2013, around 02:30 on June 7, 2013, the Defendant: (a) stolen the Defendant with one Samsung Electronic Telecommunications set up in G main points located in Gangnam-gu Seoul Metropolitan Government F; (b) the victim H, an employee of the said main point, on a different table; (c) the market price of the victim’s ownership, which was 50,000 won.
2. Around 02:08 on June 1, 2013, the Defendant, within the G main point of the victim I’s operation in Gangnam-gu Seoul, Gangnam-gu, Seoul: (a) presented to H, an employee of the said main point, as if he was a legitimate holder of the national card that stolen as referred to in the foregoing paragraph 1(a), paid KRW 90,000 for alcoholic beverages by the said national card.
From around that time to June 8, 2013, the Defendant acquired property profits equivalent to KRW 968,000 in total by the same method over 25 times, such as the list of crimes in attached Table, from around that time.
3. The Defendant in violation of the Specialized Credit Financial Business Act used the stolen or lost credit cards at the time, place, and the method set forth in paragraph (2) above.
4. On June 1, 2013, the Defendant attempted to capture a stolen national card, such as the foregoing 1-A, at the K convenience store located in the Gangseo-gu Seoul Northern District, Gangnam-gu, Seoul, and to withdraw 300,000 won in cash managed by the Defendant’s National Card, but failed to withdraw due to password errors.
5. On June 8, 2013, the Defendant: (a) around 04:00 on June 8, 2013, at the children’s park playground 447-1 located in Gangnam-gu Seoul, Gangnam-gu, Seoul; (b) one copy of the Victim L’s People’s and Business Card.
