Reasons
1. Basic facts
A. The Plaintiff: (a) on January 5, 2007, upon receipt of the guidance amounting to KRW 400,000 and KRW 100,000 for each month, from the following month, the Plaintiff: (b) opened and operated the sequence No. 25 in order to separately pay damages for delay at the rate of 2% per month (hereinafter “the No. 1 column”); (c) pursuant to the prescribed sequence, the pertinent guidance was operated by the method of receiving KRW 10,000 for each month the guidance amount to KRW 10,000 for each month; and (d) one member of the several old accounts was entitled to join the said fraternity.
In addition, the Plaintiff recruited and operated the sequence No. 25 on June 5, 2007 (hereinafter “No. 2”) in the same manner as above; ③ on February 5, 2009, the sequence No. 25 on February 5, 2009 (hereinafter “No. 3 Net”); ④ on July 5, 2009, the sequence No. 25 on July 5, 2009 (hereinafter “No. 4 Net System”); ⑤ on March 5, 201, the sequence No. 25 (hereinafter “No. 5 Net System”) respectively.
B. On January 5, 2007, the Defendant subscribed to five units (one unit, two units, three units, six units, one unit, five units) in the first real world of 1, 207, and two units (two units, one unit, seven units, and one unit) in the second real world of 5, 207. From January 5, 2007 to February 4, 2009, the Defendant received KRW 66,350,000 from the Plaintiff as stated in the attached list of accounts and the payment status of accounts, and paid KRW 51,725,000 to the Plaintiff.
C. The Defendant: (a) settled the accounts of KRW 28,675,00 in total amount of KRW 28,675,000 in the accounts of the first, second, and second, those accounts not paid by February 4, 2009 (= KRW 51,725,00 in the accounts paid by the Defendant according to the sequences); and (b) KRW 3,650,00 in the accounts of the first, second, and second, those accounts not paid by the Plaintiff (i.e., KRW 70,00 in the accounts by the sequences 76,350,000 in the accounts paid by the Plaintiff); and (c) the remaining unpaid amounts of KRW 25,025,00 in the accounts of the accounts paid by the Plaintiff (= KRW 28,675,000 in the account amount of KRW 30,50,000 in the account amount paid by the Plaintiff).
