Reasons
Punishment of the crime
1. No person who evades customs duties shall file a false declaration on the dutiable value, tariff rate, etc. in order to affect the determination of the amount of customs duties;
Nevertheless, on December 6, 2010, the Defendant: (a) imported 5,934 of “101 Model”; (b) 3,260 of “3101 Model”; (c) 1.52 of the actual unit price; (d) reported 1.3 and 1.81 of the actual unit price so as to be less than 1.3 and 64.08 of the total import price (Korean USD 1,937,638); and (b) evaded customs duties of 251,890 of the total import price (Korean USD 1,64.08), which are the difference in the total import price, from around that time to November 4, 2013; and (b) subsequently, (c) evaded customs duties of 375,086 of domestic goods through the same method as indicated in “1 of the List of Crimes”; and (d) evaded customs duties of 107 U.S. dollars 4,6365,639,63945.65
2. No declaration shall be filed with intent to manipulate the price of goods for the purpose of acquiring unjust property or property benefits when filing a declaration on exportation or importation of price manipulation goods;
Nevertheless, on August 29, 2013, the Defendant exported the original set of KRW 24,045 km as indicated in [Attachment Table 2] on August 29, 2013, and reported the actual price of the exported goods for the purpose of evading customs duties by reporting the original price at a low price, thereby undermining the actual price of the export goods as if the price was 26,097,317.
3. In cases of importing falsely declared goods, the description, quantity, quantity, price, etc. of the relevant goods shall be reported to the head of the relevant customs office, and such declaration shall not be made falsely.
