2. 공동 재물손괴의 점에 관한 사실오인 주장에 대한 판단 원심과 당심이 적법하게 채택하여 조사한 증거들에 의하면 인정되는 다음과 같은 사정들 즉, 피고인은 원심법정에서 자신이 피해자 운행 택시의 뒷 부분을 찬 사실이 있다고 자백한 점, A도 원심법정에서 피고인이 택시를 찼다고 진술한 점, 피해자 F는 수사기관 및 당심 법정에서 일관되게 택시 뒷 범퍼를 찬 사람으로 피고인과 A을 지목하였고, 목격자인 H 작성의 진술서에 의하더라도 택시 뒷 범퍼를 찬 사람으로 피고인과 A이 지목되고 있는 점 등을 종합하면, 이 부분 공소사실을 유죄로 인정할 수 있으므로, 피고인의 이 부분 사실오인 주장은 이유 없다.
