The judgment of the court below is reversed.
The defendant shall be innocent.
Reasons
1. Judgment on the defendant's appeal concerning the guilty portion of the judgment below
A. The summary of the facts charged is as follows: (a) The Defendant, as a research institute for the Korean Testing and Research Institute for Chemical Convergence (hereinafter referred to as the victim foundation), is a research institute for the appointment of the Korea Testing and Research Institute on November 25, 2015 to around 30, 2015; (b) conducted a test for F requested by the victim foundation E at the E center of E E, and completed the test on November 30, 2015; and (c) completed the test result, the Defendant must conduct a test according to the conditions set out during the above test period and obtain approval from the person in charge of the technology of the victim foundation.
A) Nevertheless, despite the measurement of the self-location function of a port detection device, the defendant written the above examination result “4.3.11. result” column of “4.3.11. measurement of the self-location function of the detection device” on the 18th page “4.3.3. measurement of the detection function of the detection device,” [Attachment 1] as shown in the same examination result, part of “4.1.0 result” in the “4.1.0 frequency frequency measurement” on the 12th page “4.1.1.0” was inserted as it was as it was.
B) 4.6. The assessment of the navigation detection level was also conducted by the Defendant, as shown in attached Form 2, “4.1.9 test content,” “4.6.10 test result,” “4.6.11 test result,” “4.6.13. test result,” and “4.6.13. test photograph” column of “4.6.10 test result,” “4.1.9 test content,” “4.10.10.1,” “4.11.1,” “4.11.1,” and “5.0.5.15.25.15.15.15.3 of the test result,” written by the Defendant on Nov. 13, 2015, as indicated in attached Form 2.
As such, the Defendant copied the test result of another item or the test result previously conducted, and completed the examination in accordance with the conditions presented during the period from November 25 to 30.
