The prosecution of this case is dismissed.

Indictment

A. On May 18, 2020, the Defendant: (a) around 14:30 on May 18, 2020, at the C Hospital in Seo-gu in Gwangju, damaged the honor of the victim D by openly pointing out facts at a place where many unspecified people pass by putting up the Preamet containing the phrase “CD Doc Do Do Do Do Do Do Do Do Do Do Do Do Do Do Do , and making no longer any such damage.

B. On May 21, 2020, the Defendant, at around 10:06, conducted one person’s demonstration at the place under the above paragraph (1) in the same manner as that under the above paragraph (1), thereby impairing the honor of the victim D by openly pointing out facts at a place where many unspecified people pass.

Judgment

The above facts charged constitute an offense falling under Article 307(1) of the Criminal Act, which cannot be prosecuted against the victim’s explicit intent under Article 312(2) of the Criminal Act.

On December 11, 2020, after the prosecution of this case, the victim expressed his intention not to be punished.

The public prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
