1. The Defendant’s KRW 9,106,80 with respect to the Plaintiff and the Plaintiff’s 5% per annum from June 30, 2018 to February 3, 2021, and the following.

1. Facts of recognition;

A. On June 2018, the Plaintiff introduced the introduction from the Defendant, who operates the D Authorized Brokerage Office located in Chungcheong City, to raise higher level than the surrounding land. Of the parts where fruit trees are planted, the Plaintiff intended to purchase 200 square meters on the side of the road (part of 3,078 square meters in Chungcheongnam-si, E-U.S.). The Defendant, along with the Plaintiff, presented to the Plaintiff a field answer and explained to the Plaintiff as if it was 200 square meters on the side of the road among the parts where fruit trees are planted.

B. On June 15, 2018, the Plaintiff entered into a sales contract with Nonparty G to purchase the instant land in KRW 190,000 from Nonparty G as a broker by the Defendant’s brokerage at the said D Authorized Broker Office (hereinafter “instant sales contract”).

According to the instant sales contract, the Plaintiff paid G a total of KRW 190,000,000 (= KRW 171,000,000,000), which was the down payment around June 5, 2018, and the remainder of KRW 171,00,000 on June 29, 2018 (= KRW 19,000,000) and completed the registration of transfer of ownership in relation to the instant land, and the Defendant paid KRW 1,710,00,00 as a brokerage fee.

그 후 원고는 충주시 E 토지 중 200평을 이 사건 토지로 알고 위 토지에 말뚝을 박고 팻말을 붙여 두거나 일부 죽은 나무를 뽑아내는 등 관리를 하였는데, 2019. 5. 7. 경 충주시 E 토지 소유 자로부터 전화로 항의를 받고 토지의 경계를 확인하는 과정에서 피고의 설명과 달리 이 사건 토지가 주변 땅보다 높게 돋워 져 있고 과수나무가 심어 져 있는 부분 중 도로 쪽 200평이 아님을 알게 되었다.

From that time, the Plaintiff demanded the invalidation of the instant sales contract, etc. to the effect that the Plaintiff purchased the instant land with a misleading knowledge about the boundary of the instant land by deceiving the Defendant.
