A shall be punished by imprisonment of 10 months, by imprisonment of 6 months, and by a fine of 2,00,000 won, respectively.

Punishment of the crime

A game products related business entity shall not allow others to engage in gambling or other speculative acts using game products, and no one shall exchange, exchange, arrange for exchange or repurchase tangible or intangible results obtained through the use of game products.

1. Defendant A

가. 피고인은 2013. 8. 16.경부터 2013. 9. 3.경까지 전주시 완산구 G건물 2층에 있는 ‘H’ 게임장에서 ‘파도소리3’ 게임기 41대를 설치한 후, 등급분류를 받은 내용과 달리 속칭 ‘똑딱이’를 올려놓아 시작버튼을 연속적으로 눌러주기만 하면 자동으로 게임이 진행되고 출현한 동물의 종류의 따라 정해진 점수를 취득하며 획득한 점수 5,000점당 아이템카드 1개씩 배출되는 내용으로 손님들의 이용에 제공하고, 아이템카드 1장당 4,500원씩을 현금으로 환전해 주어 게임물을 이용하여 도박 그 밖의 사행행위를 하게 하고, 게임물의 이용을 통하여 획득한 유ㆍ무형의 결과물을 환전하였다.

나. 피고인은 2013. 9. 13.경부터 2013. 9. 15.경까지 위 게임장에서 ‘레드피쉬2’ 게임기 40대를 설치한 후 등급분류를 받은 내용과 달리 속칭 ‘똑딱이’를 올려놓아 시작버튼을 연속적으로 눌러주기만 하면 자동으로 게임이 진행되고 출현한 동물의 종류의 따라 정해진 점수를 취득하며 획득한 점수 10,000점당 아이템카드 1개씩 배출되는 내용으로 손님들의 이용에 제공하고, 아이템카드 1장당 9,000원씩을 현금으로 환전해 주어 게임물을 이용하여 도박 그 밖의 사행행위를 하게 하고, 게임물의 이용을 통하여 획득한 유ㆍ무형의 결과물을 환전하였다.

2. Defendant B, from September 27, 2013 to October 1, 2013, installed 40 game machine “rash2” in the “H” game room located on the second floor of the building located on the Y of the Y-gu Seoul Special Metropolitan City (Seoul Special Metropolitan City).
