A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. 2. On November 29, 2017, the Defendant, in violation of the Act on Fraud and Credit Specialized Financial Business, purchased tobacco from “F convenience store” working for the victim E, who was in Busan Franchising-gu, Busan, as an employee, and presented a card as if the victim E were the lawful holder of the Franchising card, and obtained the card from the victimized party, and acquired the card with KRW 4,000 from the injured party, and used the stolen C’s check.
3. On November 29, 2017, the Defendant violated the Act on Specialized Credit Financial Business: (a) obtained pecuniary benefits of KRW 70,000,00 and used the PC card under the name of stolen C by inserting the fee to enter and wanting to use the PC card, which was stolen from the unmanned charging machine managed by the injured party, from around 04:18 on the same day, by means of inputting the fee of KRW 10,000,000 by means of inputting the information without authority into the information processing system, such as paying KRW 70,000,000 in total by means of the same five means, as shown in Table 1 of the Crimes List (1).
4. On November 29, 2017, the Defendant used a computer, etc.: around 15:45, the Defendant settled KRW 50,000 by entering the name, resident registration number, cell phone number, and other personal information and the certification number transmitted to a stolen C’s portable phone operator who purchased a game machine after having access to the “S-to-S-to-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-S-
