A defendant shall be punished by imprisonment for two years.

Punishment of the crime

[Majority Offense] On August 18, 2017, the Defendant was sentenced to imprisonment for two years and two months at the Suwon District Court for the crime of violation of the Narcotics Control Act (hereinafter “Narcotic Control Act”), and completed the execution of the sentence on December 17, 2018.

[200 Highest 3499] The Defendant treated the psychotropic drugs-related Mebacule (one philopon; hereinafter referred to as “philopon”) and the hemp plant (the macule leaves; hereinafter referred to as “macopon”) as follows, although it is not a person handling narcotics:

1. At around 12:00 on September 11, 2019, the Defendant: (a) received philophones by a method of putting about 1g of philophones contained in vinyl B in Vinylphones, Nam-gu, Incheon, Nam-gu, Seoul, in a non-hospitalized room for two stories in the second floor; and (b) received philophones from D without compensation.

2. At around 23:00 on July 5, 2020, the Defendant administered philophones by inserting approximately 0.05g philophones into a single-use injection machine in public toilets in E, and taking them into use of raw water, and administering philophones in a way of injecting the Defendant’s upper body.

3. The Defendant smokes marijuana at the time and place described in paragraph (2) by inserting approximately 0.3g of marijuana in the hemp pipe of the string material in the manner of inhaleing in the joints and ins and ins and inss the smoke generated by inserting the fire.

4. At around 16:20 on July 7, 2020, the Defendant carried a total of 8.41g and the above marijuana, respectively, by inserting approximately 1.02g in total of 1.02g and 3.42g in a single-use vinyl, which is subdivided into 7.39g in a small amount of vinyl 16 to the left part part part part part part part part part part part part part part part part part part part part part part part of the Defendant’s hand part part part part part part part part part part part part part part part part of the Defendant’s hand part part part part part part part part part part part part part part part part part part of the Defendant’s part part part part part part part part part part part part part part of the Defendant’s part part part part part part part part part part part part of it.
