1. The defendant shall be punished by imprisonment for a period of one year and six months;

2.Provided, That the above sentence shall be executed for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was in the position of D Chairperson when substantially operating D/C of 40.86% higher than the total number of shares issued by E, the primary shareholder of D.D.

G(Detention Prosecution on May 9, 2014) served as an employee in the Chok-ro and F.

G and F’s share of 20%

G’s East H (the indictment of detention on August 19, 2013) etc. decided to artificially support D’s share price through market price manipulation, and ordered the Defendant to sell and purchase D’s shares with securities accounts, such as I, etc., and the Defendant, upon receiving instructions from G, etc., conducted market price manipulation as stated in the list of offenses.

1. Crimes of making the primary manipulation;

(a) No one who has conspired or who trades listed securities shall engage in an act of purchasing or selling securities in collusion with another person in advance, with the intention to mislead another person into booming the trading of listed securities or mislead another person to make a wrong judgment with regard to the trading of listed securities, or sell or purchase securities in the same price or agreed value as he/she sells or purchases the securities at the same time as he/she sells or purchases the securities, or sell or purchase securities without the intention to transfer his/her right in selling or buying the securities;

Nevertheless, the Defendant, in collusion with G, H, etc., issued an order to sell 650 shares of D stocks to 4,910 won per share by using one of the J securities account (Account Number K) in the name of the F Office located in Gangnam-gu Seoul around February 3, 2010 for the purpose of making a false judgment or causing other persons to make a false judgment. On the same day, around 11:12:38 of the same day, the Defendant issued an order to purchase 450 shares of D stocks of 450 won per share using the Korean Securities account (Account Number L) in the name of I in around 1:12:38 and immediately issued an order to purchase 4,910 won per share and purchase 4,910 won per share and purchase 260 shares per share in the same manner as shown in attached Table 1-1 in attached Form 1-1.
