A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. Around September 7, 2008, the Defendant entered into a contract to purchase KRW 700,000,000 for the purchase price, but at the time, the Defendant, as a person with bad credit standing who does not have a certain occupation, was not capable of paying the purchase price in full. Therefore, the Defendant borrowed approximately KRW 400,000 from a financial institution as collateral and purchased KRW 130,000 from a financial institution. Around October 7, 2008, the Defendant purchased KRW 130,000,000 from a financial institution. However, even though the Defendant agreed to purchase KRW 130,00,00,000 from a financial institution as collateral, the Defendant purchased each real estate by paying KRW 130,000,00 which is equivalent to the sale price of the said real estate.

The Defendant purchased each real estate as above, and then created a site for electric source on the window C at Gyeongwon-si, Gyeongnam-si, and created farmland site at Gyeongnam-gun, and tried to secure profits by resaleing each real estate after raising the value of the above real estate. However, the Defendant had no other means to cover the construction cost, but had no other means to cover the construction cost, and the Defendant had no means to pay interest on the financial obligation borne by the real estate as collateral for the purchase of the above real estate. The Defendant was already unable to obtain a loan to use the amount equivalent to the exchange value of the real estate as a loan for the purchase of real estate by using the money for the purchase of real estate. Therefore, there was no intention or ability to increase the exchange value of each real estate by constructing a site for electric source housing and a farmland

Nevertheless, the Defendant, around May 2009, invested the money in real estate by the victims G at the Changwon-si University of the Changwon-si, Changwon-si, Seoul. However, the Defendant invested the amount of KRW 5,00,000 in real estate.
