1. The Defendant shall pay 44,259,500 won to the Plaintiff and 20% per annum from January 13, 2015 to the day of complete payment.

Basic Facts

On March 7, 2014, the Plaintiff entered into a contract with the Defendant for supply of ready-mixeds by determining the payment method as “the last day of the following month after the end of the month,” and supplied ready-mixeds equivalent to KRW 44,259,500 to the Defendant from September 1, 2014 to October 3, 2014.

[Ground of recognition] According to the above facts of recognition as to Gap evidence Nos. 1 through 4 and the purport of the entire pleadings, the defendant is obligated to pay to the plaintiff 4,259,500 won of the above ready-mixed and damages for delay at the rate of 20% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from January 13, 2015 to the date of full payment, as claimed by the plaintiff, after the above payment date.

Therefore, the plaintiff's claim is reasonable, and it is decided as per Disposition.
