1. The defendant,
A. 6% per annum from June 1, 2013 to August 3, 2015 to Plaintiff A, as well as from KRW 1,012,130,290.
Reasons
1. Indication of claim;
A. Plaintiff A operates a gas station in Gumi-si B, and Plaintiff A’s sampling energy is operated in 20-22, 55-No. 20-o, Seosung-ro, Daejeon Pungpo-ro.
B. On March 15, 2013, Plaintiff A entered into an oil supply agreement with the Defendant to pay the price on the 30th day of the following month after the end of each month, and supplied oil to the Defendant. Plaintiff A did not receive KRW 1,012,130,290 for the oil price of 590,70 square meters for transit supplied from April 4, 2013 to April 23, 2013.
C. On May 5, 2013, Plaintiff pool Energy Co., Ltd. entered into an oil supply contract with the Defendant to pay the price as at the end of the following month after the end of each month, and supplied oil to the Defendant. From May 6, 2013 to May 31, 2013, Plaintiff 1,725,532,158 oil prices of diesel 1,035,356liters supplied from May 6, 2013 to May 31, 2013; and Plaintiff pool Energy Co., Ltd. supplied KRW 130,902,712 won, which was paid KRW 919,021,490, and the remainder of KRW 937,413,380, which was not paid.
Therefore, the Defendant is obligated to pay the Plaintiff A the annual amount of KRW 1,012,130,290 from June 1, 2013 to August 3, 2015, which is the day following the due date for the payment of the oil price of KRW 1,012,130,290 and the due date for the payment of KRW 6% from June 1, 2013 to August 3, 2015, which is the day for the delivery of a copy of the complaint of this case, and the annual amount of KRW 20% from the next day to the day for the full payment of the complaint of this case. The Defendant is obligated to pay the Plaintiff pool Energy Co., Ltd. the amount of KRW 937,413,380 and the annual amount of KRW 806,510,668, which is the day following the due date for the payment of the oil price of KRW 130,902,712 from the day following the due date for the payment of each lawsuit to August 1, 2015.
2. Judgment without holding any pleadings under the Civil Procedure Act.
