A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

1. From August 201 to June 2013, the Defendant, from around 2011 to around 2013, operated a mobile phone retail store in the name of “D” with friendship C in Daegu-gu, and operated a mobile phone retail store. From around August 2012, the Defendant entered into a contract with the victim (ju), (ju), ELfer, victim (ju), victim (ju), victim (ju), victim (ju), and (ju), F agency operated by the victim E, and H agency operated by the victim, and was engaged in the sales of the entrusted mobile phone through the “D”.

At around 11:30 on November 19, 2012, the Defendant: (a) removed three mobile phones equivalent to KRW 2,992,00 from the total market value of 814,00,000, the market value of which is equivalent to KRW 1,089,00, and the total market value of 814,000,000, which was supplied and stored in the display stand on the part of the victim’s note; (b) removed three mobile phones equivalent to KRW 2,992,00,00 from the total market value of 8,08,00,000; and (c) immediately sold to the I, who is a mid- and long-term mobile phone operator,

From around that time to June 10, 2013, the Defendant: (a) deducted 110 cell phoness equivalent to KRW 106,538,400 from the market price over 46 times in total as indicated in the attached Table 1, such as the above method, etc. from around that time to around June 10, 2013; and (b) consumed them in the way of

Accordingly, the defendant embezzled the victims' property.

2. From Jun. 2013, the Defendant had a mobile phone retail store operated by the victim K in Daegu-gu J from Jun. 2, 2013 to sell mobile phones.

The defendant, around 14:00 on June 11, 2013, had 2 gal lusium 899,800 won at each market price, which was kept in the display stand, using the gap in which the victim was able to watch by making it difficult for the victim to watch.

The Defendant, from around that time to June 22, 2013, had 11 mobile phones worth KRW 10,001,00 in total nine times as shown in the annexed Table 2, with the same method, etc.
