A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. On October 2010, the Defendant made a false statement to the victim D, who was aware of a relationship in the mutually in the instant coffee shop located in Gangnam-gu Seoul, Gangnam-gu, Seoul, that “I would make a settlement of the price of the card on the face of a week by purchasing the Nowon-gu, laundry, etc. with a card without a credit card.”
However, at the time, the Defendant did not have any money such as consolation money, while divorced from her husband, and there was no other intention or ability to pay the card price of the victim because she did not have any other property.
Nevertheless, the Defendant, by deceiving the victim as above, purchased a sum of KRW 2,037,330,00 from the victim on October 6, 2010, KRW 712,90 from the victim, KRW 380,370 on the laund of the same month, KRW 199,00 on November 3, 14 of the same year, and KRW 745,060 on the 11th day of the same month, and acquired property gains by failing to pay the card price.
2. Around November 3, 2010, the Defendant made a false statement to the effect that, “If the Defendant 8,000,000 won is playing in money while lending 8,00 won to surplus funds, 5% interest shall be collected from 10% per month and the principal shall be refunded after six months.”
However, it was difficult to carry out such circumstances as the above Paragraph 1, so even if the victim borrowed money, there was no intention or ability to pay the money.
Nevertheless, the Defendant, by deceiving the victim as above, was delivered KRW 7,500,000 after deducting the amount of KRW 500,000 from the victim’s name to the passbook in the name of the Defendant.
3. On December 18, 2010, the Defendant: (a) at the instant coffee shop located in the Gangnam-gu Seoul Eastdong on December 18, 2010, the Defendant: (b) extracted the rental car from one another to another and extracted it from the car.
