In the event that the Defendants did not pay the above fine, each of them is 100.

A was a candidate for the EFF election (hereinafter referred to as the “instant election”) implemented on March 11, 2015, and Defendant B was a member of EFF middle school.

1. No one shall publish any false fact about a candidate, lineal ascendant or descendant, etc. disadvantageous to the candidate, or slander a candidate, etc. by openly pointing out a fact for the purpose of election campaign, with the intention of preventing the candidate from being elected, with the intention of prohibiting the candidate from being elected, and no person other than the candidate shall engage in an election campaign;

Defendant

A around November 2014, upon requesting Defendant B to seek a mobile phone to be used in the election of the head of the instant association, and Defendant B provided Defendant B with G’s mobile phone name (H) and Defendant A provided Defendant A with the aforementioned mobile phone for an election campaign by inputting 597 mobile phone numbers, etc. on the said mobile phone.

피고인들은 2015. 2. 말경 위 사무실에서, 이 사건 조합장선거에서 당선이 유력한 후보자로 거론되던 I와 J이 당선되지 못하게 할 목적으로, 위 후보자들 및 그들의 직계비속에 관한 비방성 문자메시지를 작성하여 위 G 명의 휴대폰을 사용하여 조합원들에게 전송하기로 마음먹고, 피고인 A은 전송할 문자메시지 초안을 작성하여 피고인 B에게 넘겨주고, 피고인 B은 위 휴대폰에 “청와대도 대통령친인척은근무못합니다 I후보(아들,며느리) J후보(딸) 직계가족이농협에근무하는데 조합장출마라니 소가웃네요 도덕성에문젭니다 직계가족 지점장승진시키려고요 한심한 E농협! 후보사퇴시킵시다 대의원 K 배상”이라는 내용의 문자메시지를 입력한 후 이를 임시저장 해 두었다가, 2015. 2. 27. 23:24경 L아파트 주차장에 정차된 피고인 A의 승용차 안에...
