1. The Defendant: KRW 32,912,445 for the Plaintiff and KRW 5% per annum from November 8, 2013 to October 16, 2014.

1. Basic facts

A. The Plaintiff Company is an electronic tendering service company that provides information, such as bid information, data analysis, bid price, etc. on bidding ordered by a government agency or a public institution, which is conducted at a national electronic procurement site (htp:/www.g2b.go. Sr (hereinafter “Bater site”) operated by the Procurement Service, and the Defendant Company is a company that mainly engages in mechanical equipment construction business and fire-fighting equipment construction business.

B. On March 29, 2013, the Plaintiff Company and the Defendant Company concluded an electronic bidding advisory service contract (hereinafter “instant advisory service contract”).

The main contents of the advisory contract of this case are as follows.

(1) The advisory service fee for successful tender (hereinafter referred to as the “instant advisory service fee”) shall be 2% (including surtax) of the successful tender amount.

(a)providing facilities, services, purchases, or tendering information;

(b)providing data analysis results;

C. The Defendant Company is deemed to have received a successful bid advisory service from the Plaintiff Company for the bid case, where the Defendant Company was informed of the price point through the “successful analysis room” on the Plaintiff Company’s website, and where the “successful Tender Prediction” is charactered, the Defendant Company shall be deemed to have received a successful bid advisory service from the Plaintiff Company, and the Defendant Company shall pay the instant advisory service fee to the Plaintiff Company when the Defendant Company becomes final and conclusive as the first or final successful bidder for the said bid case.

(4) The deadline for the payment of advisory fees of this case: Payment within 30 days from the award date

C. After entering into the instant advisory contract with the Plaintiff Company, the Defendant Company was awarded the bid for the total of five construction works on the website of the Plaintiff Company upon consultation with the Plaintiff Company as follows.

On May 30, 2013, 168,841,500 won for toilet improvement machinery and equipment works at the Robong Elementary School on May 31, 2013, 506, 506, and 245.
