A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

"2019 Highest 7979"

1. A thief: (a) around August 8, 2019, around 03:43, the Defendant: (b) placed a thief 1 and a thief beneficiary equivalent to KRW 3,500 of the market price managed by the victim D in the “C” located in Suwon-si Suwon-si District B; and (c) stolen the thief.

2. On October 4, 2019, the Defendant: (a) obtained one credit card in the name of one bank in the name of the victim, where the victim F was lost on the road of the Suwon-si waterway E on the road; (b) around October 19, 2019.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

3. Computer etc. fraud or violation of the Specialized Credit Financial Business Act;

A. On October 4, 2019, the Defendant settled KRW 30,000 by using one bank credit card, which he/she acquired, as provided in paragraph (2), when charging the PC usage fee from an unmanned information device installed at the “HPC bank,” operated by the victim on the second floor, at the G of Young-si, and the “HPC bank” operated by the victim on the second floor.

B. On October 4, 2019, the Defendant ordered 21,200 won by using the credit card of one bank, which was obtained as provided in paragraph (2), using the unmanned information device installed at the J, which is operated by the victim on the I and I in the first floor of the Suwon-si, Ma-si.

Accordingly, the Defendant acquired property benefits by inputting information without authority into a computer and other information processing device at least twice in total, and used the lost card.

4. Fraud and Specialized Credit Financial Business Act violation Defendant orders the victim under his/her name in a business establishment located in Suwon-si K on October 4, 2019 and the right to use the credit card as provided in paragraph (2).
