1. The plaintiff's appeal is dismissed.
2. At the preliminary claims added at the trial, the Defendants are jointly and severally liable.
Reasons
1. Basic facts
A. The Plaintiff became aware of the Defendant B who works as an intermediary assistant at the M Licensed Real Estate Agent Office located in Yangyang-si L around the beginning of 2012, and through Defendant B, the Plaintiff was introduced the Defendant C (name E prior to the opening of the name) working as an intermediary at the said office.
B. 107 commercial building related to 107 commercial building is recommended to make an investment because the Plaintiff sold the building in a separate city by the Defendants and could bring profits to the Plaintiff. The Plaintiff is recommended to make an investment in the commercial building in the Namyang-si, Namyang-si, G 107 (hereinafter “107 commercial building”).
(2) On April 20, 2012, the Defendants paid 30,000,000 won for subscription to the sales agency through the Defendants. On June 28, 2012, Defendant B paid 132,119,512 won for the balance remaining after deducting the said subscription amount from the down payment. (2) On June 28, 2012, Defendant B concluded a sales contract for commercial buildings with its own name and with its own name 810,597,560 won.
3) The intermediate payment of KRW 81,50,00, which is a part of the intermediate payment of the commercial building No. 107, was paid. around January 2013, the commercial building No. 107, which was sold to H in the name of the contracting party, at KRW 243,165,000, without being left in the name of the contracting party B. Since the sales contract for the commercial building No. 107 was cancelled on December 31, 2013, Defendant B was returned from the managing company 209,660,000, which deducts KRW 34,000,000 in the name of the penalty, out of KRW 243,660,000, which was paid for, the sales contract for the commercial building No. 2407,000, the Plaintiff recommended the Defendants to make an investment of KRW 103,03,00 in the name of the neighboring licensed real estate agent office, and the amount invested by the Defendants 300,200.
2. N in 103 of the above 230,000,000 won delivered by the Plaintiff is about the commercial building from the Plaintiff.
