A defendant shall be punished by imprisonment for a term of one year and four months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Mesing employee misrepresented the employees of the financial company, and made a false statement to the effect that “if the existing loans are repaid, it would cause a low interest loan to be paid in cash,” or “it constitutes a breach of a contract and constitutes a seizure measure, and thus, the existing loans should be repaid.” After having contacted the Defendant through the Mesing Program, made the victims believe that the victims would be able to have the victims misrepresent the employees of the financial company or transfer the forged documents, such as “the certificate of forced payment in full,” etc., the victims would be able to receive cash in the name of the repayment from the victims and transfer them to the designated account, and the Defendant would receive cash from the victims in a place where the victims knew of the name in accordance with the above order, and made a public offering in sequence by the person who has designated the account to transfer the remaining amount excluding the amount of money from KRW 150,000 to KRW 50,000,000,000.

1. On August 7, 2020, the person who was unaware of the name of fraud made a false statement to the effect that he/she assumes C bank staff and calls to the victim D to “be in charge of C bank, and would make a substitute loan at low interest if he/she redeems the existing loan.” On August 7, 2020, the Defendant received KRW 171,398,000 from the total eight victims, such as the attached Table 1 re-off from around August 24, 202 to August 24, 202, the Defendant: (a) misrepresenting the victim of C bank at the above end; (b) misrepresenting the victim’s staff; and (c) sending the remainder of 9.33,00 won to the account designated by the victim with no passbook; and (d) receiving KRW 171,398,00,000 from the total eight victims, such as the attached Table 1 re-off until August 24, 2020.
