The judgment below
Examining the reasoning of the record, it is justifiable for the court below to maintain the judgment of the court of first instance which acquitted each of the charges of this case (excluding the part which judged guilty in the judgment of the court of first instance) on the grounds as stated in its reasoning, on the ground that there is no evidence of crime, and there is no error of exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules
Meanwhile, although the prosecutor appealed to the entire judgment of the court below, the part of the conviction did not state the grounds for appeal, and the appellate brief does not state the grounds for appeal.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
