A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

1. On January 3, 2017, the Defendant: (a) met the Victim F (23 years of age) introduced through E in the vicinity of the D Station located in Gyeonggi-si, Gyeonggi-si, Gyeonggi-si, with a view to attempting to sexual intercourse by using those that interfere with intellectual ability; (b) opened a film with the victim’s mind, with the victim’s intent to attempt sexual intercourse; (c) opened the victim’s own body against the victim’s will; and (d) laid off the victim’s chest and sound with his/her clothes on his/her hand; and (c) laid off his/her clothes in full, “I am back his/her chest and sound; (d) then, I am off the victim’s clothes without disregarding the victim’s intent to refuse sexual intercourse.”

Accordingly, the defendant committed an indecent act against the victim with mental disability by force.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media);

A. On January 1, 2017, the Defendant participated in an organization I, in which the victim H and other intellectual persons with intellectual disabilities use the clinic of “G” by using his/her personal phone at the early police station, and then the victim, who did not have a face-to-face type, participated in an organization I, in which the victim had a mutual conversation by a text message. C. Sending by affixing by affixing a seal of a sex-related act

The delivery shall be made by putting off the entire clothes and sprinking a photograph.

The letter message, such as “satisfy”, was transmitted.

Accordingly, the defendant has caused sexual humiliation or aversion using communication media for the purpose of inducing or satisfying his own sexual desire.
